Setting up "Martial Arts Leisure UK Ltd"
Although it was not known at the time (February 2004) but during the week the Beaven's were supposedly seeking legal advice and having the loan agreement drawn up by HSBC, they were in fact setting up their new company in preparation for their take over.

Martial Arts Leisure UK Ltd is shown on companies house to have been a "ready made" company that had a name change on or around the 24th February 2004, basically the week after the list was handed in to the Beaven's. While there is no evidence that the advice to do this came from the Solicitors dealing with company issues and the litigation, Andy Wright did have a wierd telephone conversation with the main Solictor who said: "TMAC is worthless and not worth worrying about. It is valueless. I am advising you just forget about it, it has no assets".

The takeover date turned out to be May 2004, and came about because the Beaven's, in full control of the business and not allowing any access by the Wright's, stopped paying the rent to WWDC. Andy Wright was sent an email by the Agent that explained the lease had become forfeit due to non-payment of rent and service charges, amounting to approx £6,000. The lease was in the name of TMAC. Andy was given the opportunity to take over the lease (on payment of back rent) but he did not have that sort of cash and could not see that the move would have given him a viable business, with the Beaven's still in possession of the building and equipment, but most importantly the customers and instructors.

I have been advised by the legal department, West Wiltshire District Council of the following:

The lease was deemed forfeited on the 30th April 2004.
The Martial Arts Centre company property is of no interest or relevance to the District Council, their only involvement is in the property itself.
The financial interest of the District Council is in the payment of outstanding rent and service charges. These bills have now been paid by Mr and Mrs Bevan and so the Council have no outstanding legal or financial issues with the Martial Arts Centre.
Mr and Mrs Bevan have now taken up a new occupational agreement with the District Council on unit 9 Sandown Centre.
